DISCLOSURE WITHIN THE SCOPE OF PERSONAL DATA PROTECTION

As Checkmate Future Yazılım Teknoloji Anonim Şirketi ("Checkmate"), we attach great importance to the privacy and security of your personal data. In this framework, the processing and storage of all personal data of all persons related to CHECKMATE in accordance with Law No. 6698 on the Protection of Personal Data ("KVKK") is among our priorities. With our "Data Controller" status under the KVKK and awareness of this responsibility, we wish to inform you as follows about the purposes of processing your personal data, the methods and reasons for collecting your data, your rights regarding the processing of your personal data, and the application procedures and principles for exercising these rights.

1. What Personal Data Do We Collect?

We collect personal data from our visitors, members who register via our website and/or mobile application, and our business connections. The personal data we collect includes:

  • Identity Data: Name, surname, ID number, nationality, ID copy from our customers, members, visitors and business connections.
  • Contact Data: Phone number, address, email from our customers, members, visitors and business connections.
  • Financial Data: Payment information, amount spent, bank account number from our customers, members and business connections.
  • Customer Transaction Data: Order and invoice information, transaction history, requests and complaints, Platform usage information, comments and questions, ratings, chat content, cancellation/refund information.
  • Transaction Security Data: IP address, login/logout information, password information, device information, cookies, platform access records.
  • Legal Transaction Data: Personal data processed for establishing and enforcing our legal rights and claims.
  • Visual/Audio Data: Photos, audio and video recordings from our customers, members and business connections.
  • Location Data: Location information, GPS data.
  • Marketing Data: Personal data for personalized marketing based on usage habits and preferences.
  • Special Category Personal Data: Health data, criminal record information, event photos, face liveness verification and face recognition data from our members.

2. Methods and Legal Grounds for Collecting/Processing Your Personal Data

We collect your personal data through our website and mobile application, social media, contracts, commercial offers, forms, applications, and third parties. We process your personal data based on:

  • Your explicit consent,
  • Legal requirements in force in Turkey,
  • Performance of our contract with you,
  • Fulfillment of our legal obligations,
  • Your data having been made public by you,
  • Exercise or protection of our legal or contractual rights,
  • Our legitimate interest, provided that it does not harm your fundamental rights.

3. Purposes of Processing Your Personal Data

Your personal data is processed for: performance of the contract; improving user experience; customizing products and services; user satisfaction activities; sales and marketing; customer relationship management; ensuring legal, technical and commercial security; conducting business activities; and planning commercial strategies.

4. Do We Transfer Your Personal Data to Third Parties?

We may transfer your personal data to our group companies, subsidiaries, affiliates, business partners, service providers, legally authorized public institutions and private persons, in accordance with the KVKK and for the purposes specified above. CHECKMATE undertakes that your personal data will be kept securely and will not be processed unlawfully.

5. Policy on Processing of Your Biometric Data

We process your face data as biometric data for account security, preventing fake accounts, automatic recognition and tagging of users in event photos, and improving user experience, in accordance with general principles in Article 4 and conditions in Article 6 of Law No. 6698.

5.1. Collected Face Data

Checkmate collects: (1) Face Liveness data to verify you are a real person for account security, and (2) Face Embeddings (mathematical representations) for automatic photo tagging at events.

5.2. Purpose of Use

Face data is used only for: account security, automatic photo tagging at events, and improving user experience.

5.3. Data Retention

Face Liveness data is automatically deleted within 15 minutes after verification. Face Embeddings are stored only while your account is active and are permanently deleted when you delete your account.

5.4. Third-Party Sharing

We use GDPR and SOC 2 compliant service providers for face recognition. Face data is not shared with any third parties outside of our authorized service providers.

5.5. Face Data Deletion

You can delete your face data anytime by deleting your account. The deletion is irreversible.

5.6. Your Rights Regarding Face Data

You have the right to know what face data is collected, request access, request deletion, and opt-out of face recognition features (except for event creation).

5.7. Face Data Security

We use encryption (AES-256, TLS 1.2+), access controls, monitoring, and regular security audits.

6. Your Rights Under the KVKK and Application Procedure

You have the right to: learn whether your personal data is processed; request information if processed; learn the purpose and whether used accordingly; know third parties to whom data is transferred; request correction; request deletion; request notification to third parties; object to automated analysis; request compensation for damage.

You may submit your requests by filling out the KVKK Application Form and sending it in writing or via registered email, secure electronic signature, mobile signature or your registered email address. We will finalize your requests free of charge within thirty days at the latest. You may lodge a complaint with the Personal Data Protection Board within 30 days if your request is rejected or you are not satisfied with the response.
